Digital Wallet Terms and Conditions

Please read these Digital Wallet Terms and Conditions (these “Terms”) before adding your Cari Rewards credit card (“Card”) to a digital wallet. By adding or using your Cari Rewards Card in any digital wallet, you accept and agree to be bound by these Terms. If you do not agree, do not add your Card to a digital wallet.
Scope and Parties
These Terms apply when you add your eligible Cari Rewards credit card issued by Transportation Alliance Bank, Inc., d/b/a TAB Bank (“TAB Bank”) to any third-party digital wallet, mobile payment, or tokenization service to make transactions electronically without presenting your physical Card (each, a "Wallet"). Cari Rewards Corp. (“Cari”) administers the Cari Rewards Card program on TAB Bank's behalf. The company operating your Wallet (like Apple Pay or Google Pay) is referred to in these Terms as your “Wallet Provider.” TAB Bank and Cari are not affiliated with any Wallet Provider.
TAB Bank does not own, operate, or control any Wallet. Your use of a Wallet is subject to separate terms between you and the applicable Wallet Provider. TAB Bank and Cari are not responsible for any actions taken by a Wallet Provider.
Your Cardholder Agreement Continues to Apply
These Terms supplement, and do not replace, your Cari Rewards Cardholder Agreement with TAB Bank, as amended from time to time (the “Cardholder Agreement”). The Cardholder Agreement remains in full force and effect. Any use of your Card in connection with a Wallet is subject to your Cardholder Agreement and any previously disclosed terms, including any use restrictions. Any disputes arising out of these Terms will be subject to the dispute resolution procedures in your Cardholder Agreement. In the event of any conflict between these Terms and your Cardholder Agreement, your Cardholder Agreement controls.
Eligibility
Only active accounts in good standing and Cards deemed eligible under TAB Bank and applicable card network policies may be added to a Wallet. You must be at least 18 years of age to add your Card to a Wallet. Cards may only be added to a Wallet by you or by persons authorized to use your Card under your Cardholder Agreement. You are responsible for all Wallet transactions made by any such person. We may determine and apply other eligibility criteria in our sole discretion.
Use of Tokens and Wallets to Access Your Account
A “Token” is a new Card number that may be created, assigned to a digital wallet and/or device, and used in place of your existing Card number(s). Tokens are designed to protect your Card information. When you add your Card to a Wallet that uses Tokens, you request and authorize a Token to be created and provided to the Wallet Provider. Your Wallet Provider may store, and use your Card information, including Tokens, to initiate transactions with merchants. Your Wallet may not be accepted at all places where your Card is accepted.
All transactions initiated through a Wallet are Card transactions under your Cardholder Agreement and subject to all interest, fees, payment obligations, credit limits, and other controls and terms applicable to your Card. TAB Bank may decline, suspend, or condition the creation or use of Tokens for fraud prevention, compliance, operational, card network, or any other reason, with or without prior notice. Wallet functionality does not expand or modify the permitted use categories or other account limitations set forth in your Cardholder Agreement. We reserve the right to terminate our participation in a Wallet, limit the number of Cards that can be added to a Wallet, and limit transactions (including the amount and number of transactions) made using a Wallet, at any time.
Information Sharing
Your Card is subject to our privacy policy, available at https://usecari.com/privacy. By adding or attempting to add your Card to a Wallet, you authorize TAB Bank, Cari, the applicable card network, any Token service providers, your Wallet Provider, and merchants to exchange information necessary to enable the use of your Card in the Wallet, protect from potential unauthorized use or fraud, to improve the services provided, and for any other purposes not prohibited by applicable law.
TAB Bank and Cari do not control the privacy or security of information held by your Wallet Provider or their service providers. Information obtained by a Wallet is governed by the Wallet Provider's privacy policy. Please review each Wallet Provider's privacy policy. TAB Bank and Cari do not control or warrant the use, privacy or security practices of any Wallet or Wallet Provider, including with respect to the ability of unauthorized persons to intercept, access or use information transmitted to, from, or through a Wallet.
Transaction History and Other Information
We are not responsible for the information shown in a Wallet. Transaction history and other information about your Card displayed in a Wallet may not be accurate or complete. For example, transaction amounts may not match the transaction amount that ultimately clears, settles, and posts to your account. Refer to your periodic statements for information regarding any transactions.
Changes, Suspension, and Termination
These Terms may be amended at any time. Revise Terms will be posted at [insert URL] and you accept the revised Terms by using the service after their effective date. TAB Bank retains the right to suspend or terminate Token provisioning or the use of your Card in a Wallet at any time and for any reason, including safety and soundness, legal compliance, card network rule adherence, fraud prevention, or other risk management purposes, without prior notice. These Terms and the services provided to support your use of Wallets may be changed, suspended, or discontinued at any time without notice.
License
A TOKEN IS LICENSED, NOT SOLD, TO YOU FOR USE ONLY UNDER THESE TERMS. TAB BANK AND ITS LICENSORS, INCLUDING THE APPLICABLE CARD NETWORK, RESERVE ALL RIGHTS NOT EXPRESSLY GRANTED TO YOU. You are granted a limited, non-exclusive, non-transferable, personal license to use your Token on your device in accordance with these Terms. You may not copy, reverse engineer, decompile, modify, or create derivative works of any services provided by these Terms, any Token, or any Wallet. TAB Bank and its licensors retain all right, title, and interest in and to any software used to provide your Token.
Security of Your Wallet
You are responsible for maintaining the security of any Wallet and any device on which your Card information is stored, including the protection of passwords, biometric authentication, and any other Wallet access credentials. Protect your Wallet and device just as you would protect your physical Card or Card number. If your device or access credentials for your device or Wallet are lost, stolen, or compromised, notify Cari and your Wallet Provider immediately. Failure to safeguard your device and Wallet may result in liability consistent with your Cardholder Agreement.
Contact your Wallet Provide to remove your Card from a Wallet. You may also contact Cari at support@usecari.com or U.S. 866-729-1320, Intl 332-290-3311 to request suspension or deletion of a Token from a Wallet. Suspension or deletion of a Token does not close your account. However, closure or termination of your account will result in deactivation of all associated Tokens.
Communications
By adding your Card to a Wallet, you authorize communications regarding Wallet activities to be sent by phone, text messages/SMS (standard message and data rates may apply), email, regular mail, postings on our website or mobile app, and through the Wallet.
Electronic Acceptance
Your electronic acceptance of these Terms constitutes a binding agreement and may be stored and relied upon as evidence of your consent.
Limitation of Liability; No Warranties
TAB BANK AND CARI ARE NOT AND SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR INJURY OR FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATED TO THE ADDING OF A CARD TO A WALLET, OR YOUR ACCESS OR USE OF A WALLET. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS) AS TO ANY AND ALL WALLETS AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT INCLUDED IN OR ACCESSIBLE FROM THE WALLETS.
