CONSENT TO ELECTRONIC TRANSACTIONS AND COMMUNICATIONS
Thank you for your interest in the Cari Rewards business credit card program. Please read this Consent to Electronic Transactions and Communications ("Consent") carefully and retain a copy for your records. This Consent contains important information about conducting business with us electronically, including the use of electronic signatures and your right to receive certain information and documents in electronic form.
For purposes of this Consent, "Borrower" means the business entity on whose behalf you are acting and that is applying for a Cari Rewards business credit card account. "You" and "your" refer to the individual acting on behalf of the Borrower. "Agreement" means the Cari Rewards Cardholder Agreement that will govern Borrower's account if approved. "We," "us," and "our" refer to Transportation Alliance Bank, Inc., doing business as TAB Bank, and/or Cari Rewards, LLC, as applicable. "Platform" means any online portal or website we or our authorized service providers make available for you to access Borrower's account or related information.
1. Electronic Signatures and Electronic Records
By clicking "I Agree" below, you, on behalf of Borrower, consent to the use of electronic signatures and electronic records in connection with Borrower's application, the Agreement, and all related documents and communications ("Documents"). You represent and warrant that you are authorized to act on behalf of Borrower and to provide this Consent. You agree that your electronic signature, made on behalf of Borrower, has the same legal effect as a handwritten signature. You further agree that Documents delivered electronically to Borrower have the same legal effect as those delivered in paper form.
2. Delivery of Documents
Documents may be delivered to Borrower by email, through the Platform, by posting on a secure website, or by other electronic means permitted by law. Delivery to the email address or contact information provided in the application or maintained in our records will be deemed delivery to Borrower. Borrower may print or download copies of any Document for its records.
3. Keeping Contact Information Current
Borrower must provide us with a valid email address to receive electronic Documents. It is Borrower's responsibility to promptly notify us of any changes to its email address or other contact information. Contact information may be updated by logging into the Platform or by contacting us at support@usecari.com.
4. Hardware and Software Requirements
To electronically receive, view, and save or print Documents, Borrower must have:
- A valid email account and address;
- A computer, tablet, or mobile device with an operating system and internet connection capable of receiving, accessing, displaying, and printing or storing Documents;
- A current version of a web browser (such as Chrome, Edge, Firefox, or Safari);
- Software capable of viewing PDF documents (such as Adobe Reader);
- Sufficient storage space to save Documents or the ability to print them.
If our hardware or software requirements change and that change would create a material risk that Borrower would not be able to access Documents or the Platform, we will give notice of the revised requirements. Continued use of the Platform after receiving notice of the change constitutes reaffirmation of this Consent.
5. Withdrawing Consent
Borrower may withdraw this Consent to receive Documents electronically at any time, without charge, by contacting us at support@usecari.com. Withdrawal of Consent will be effective as soon as reasonably possible after we receive notice. If Borrower withdraws Consent, Borrower may not be able to complete the application or maintain the account, as electronic delivery is required for ongoing servicing.
6. Requesting Paper Copies
Upon request, we will provide a paper copy of any Document. To request a paper copy, contact us by telephone at 866-729-1320 or by email at support@usecari.com. We reserve the right to charge a reasonable fee for providing a paper copy. A request for a paper copy will not be treated as a withdrawal of Consent to receive Documents electronically unless specifically stated as such.
By clicking "I Agree" below, you acknowledge and agree that you are providing this Consent on behalf of Borrower, that you have read, understand, and agree to this Consent, and that Borrower has the capability to electronically receive, view, and save or print Documents as set forth above.
